1. Introduction

Welcome to EvolvoBill ("Service", "Platform"), a web application provided by Kintekiro ("Company", "we", "us", "our"), a legal entity registered in Bulgaria. By accessing or using our Service, you ("User", "you") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

EvolvoBill is a SaaS (Software as a Service) platform that allows users to generate, manage, and issue invoices. We offer:

  • Free Plan: Limited functionality as described on our pricing page.
  • Paid Subscription: Full functionality billed on a monthly basis.

IMPORTANT DISCLAIMER: EvolvoBill provides software tools for administrative convenience. We are not a law firm, accounting firm, or tax advisor. The use of our Service does not constitute tax or legal advice. You are solely responsible for ensuring your invoices comply with the tax laws and regulations of your specific jurisdiction.

3. Account Registration

To use the Service, you must register an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

4. Subscriptions, Payments, and Cancellations

Billing Cycle: Paid subscriptions are billed monthly in advance.

Cancellation: You may cancel your subscription at any time via your account settings. Your access to paid features will continue until the end of the current billing cycle.

No Refunds: Payments are non-refundable. We do not provide refunds or credits for partial months of service or for months where the Service was not used.

Note for EU Consumers: By purchasing a subscription and gaining immediate access to the digital service, you acknowledge that you lose your right of withdrawal once the performance has begun.

5. Termination and Data Retention

Termination by You: Upon cancellation, your account will revert to the Free Plan or be deactivated at the end of the billing cycle, depending on your choice.

Termination by Us: We may suspend or terminate your account immediately if you violate these Terms.

Data Retention & Grace Period: If your subscription is cancelled or your account is voluntarily terminated, your data (including invoice history and client details) will be retained for a 30-day grace period. You are responsible for exporting your data during this window. After 30 days, we reserve the right to permanently delete your data from our servers.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You must not use EvolvoBill to:

  • Issue invoices for illegal goods or services in your jurisdiction or the jurisdiction of your client.
  • Facilitate fraudulent schemes, money laundering, or tax evasion.
  • Transmit viruses or harmful code.

We reserve the right to remove any content or suspend accounts that we determine, in our sole discretion, violate these restrictions.

7. Intellectual Property

Kintekiro retains all rights, title, and interest in the EvolvoBill platform, including source code, design, and trademarks. You retain all rights to the data and content you upload or generate (e.g., your client lists and invoice data).

8. Limitation of Liability

To the maximum extent permitted by Bulgarian law:

  • The Service is provided "AS IS" and "AS AVAILABLE".
  • Kintekiro shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business reputation.
  • Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bulgaria.
